TAKE NOTICE that at its regular meeting to be held on Wednesday, August 15, 2018 at 7:00 p.m. prevailing local time, at the Franklin Park Municipal Building, 2344 West Ingomar Road, Pittsburgh, Pennsylvania 15237, the Council of the Borough of Franklin Park will hold a public hearing on and thereafter consider the adoption of, and if appropriate enact, Ordinance No. 645-2018 entitled:
AN ORDINANCE OF THE BOROUGH OF FRANKLIN PARK, ALLEGHENY COUNTY, PENNSYLVANIA, AMENDING CHAPTER 212 IN THE CODE OF THE BOROUGH OF FRANKLIN PARK, “ZONING,” PROVIDING FOR PURPOSES AND FINDINGS OF FACT RELATED TO THE ADOPTION OF THE AMENDMENT; PROVIDING FOR DEFINITIONS; ESTABLISHING CERTAIN GENERAL AND SPECIFIC STANDARDS RELATING TO THE LOCATION, PLACEMENT, CONSTRUCTION AND MAINTENANCE OF TOWER-BASED WIRELESS COMMUNICATIONS FACILITIES AND NON-TOWER WIRELESS COMMUNICATION FACILITIES; PROVIDING FOR THE ENFORCEMENT OF SAID REGULATIONS; AND PROVIDING FOR AN EFFECTIVE DATE.
The Solicitor drafted the following summary: Section I details the purposes and findings of fact supporting the zoning ordinance amendment. Section II repeals the definition of “Commercial Telecommunications Tower.” Section III amends Section 212-202 of the Zoning Ordinance to provide additional defined terms. Section IV amends Table 4-5 “Table of Retail and Consumer Use Regulations” to provide additional use regulations and use classifications for non-tower and tower-based wireless communication facilities. Section V repeals and replaces Section 212-1905P to provide general and specific requirements for non-tower and tower-based wireless communications facilities. Section VI addresses miscellaneous matters including police powers, severability, and the effective date. By virtue of adopting Resolution No. 1163-2018 on June 20, 2018, the Borough Council invoked the pending zoning ordinance doctrine for proposed Ordinance No. 645-2018. All persons interested in this matter are invited to be present at the above time and place and you will have an opportunity to be heard. A copy of the full text of the proposed Ordinance may be examined by any citizen at the Franklin Park Municipal Building; at the newspaper publishing this legal notice; at the office of the Allegheny County Council Chief Clerk; and the Allegheny County Law Library, during regular business hours.
